Welcome to Antologa. These Terms & Conditions ("Terms") form a legally binding agreement between you and Antologa, S.A. ("we," "us," or "our"), a company incorporated in the Republic of Panama, governing your access to and use of our Platform at antologa.com and all associated services.
By creating an account, accessing, or using the Platform, you confirm that you have read, understood, and agree to these Terms, our Privacy Policy, and Cookie Policy. If you do not agree, you may not access the Platform.
We may update these Terms from time to time. Material changes will be communicated via email and/or a notice on the Platform. Continued use after the effective date of any change constitutes acceptance.
- Platform — antologa.com, any associated mobile applications, APIs, and related services.
- Traveler — an individual who registers to discover, browse, and book experiences through the Platform.
- Business Partner — a hotel, restaurant, spa, shop, transport operator, car rental, or adventure operator that lists services on the Platform.
- Tour Guide — an individual licensed or certified guide who creates and offers guided experiences through the Platform.
- Travel Agency — an agency or operator that packages and sells multi-component itineraries through the Platform.
- Listing — a service, experience, accommodation, product, or package made available for booking on the Platform.
- Booking — a confirmed reservation or purchase made through the Platform.
- Commission — the percentage of each Booking fee retained by Antologa as remuneration for marketplace services.
- Content — all text, images, videos, reviews, descriptions, and other materials posted on or through the Platform.
You must be at least 18 years of age and legally capable of entering into binding contracts under Panamanian law to use the Platform.
By registering, you represent that:
- All registration information is accurate, current, and complete.
- You will promptly update your information if it changes.
- You will maintain the security of your account credentials and not share your password.
- You are not prohibited from using the Platform under any applicable law or regulation.
- Your use will comply with all applicable laws of the Republic of Panama and your home jurisdiction.
You are solely responsible for all activity that occurs under your account. Notify us immediately at support@antologa.com if you suspect unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.
4.1 Marketplace Role
Antologa operates as a curated marketplace that connects Travelers with Business Partners, Tour Guides, and Travel Agencies. We facilitate discovery, communication, and booking but do not own, operate, or control the accommodations, tours, experiences, products, or services listed by partners. Each partner is an independent contractor responsible for their own services.
4.2 Subscription Plans
Business Partners, Tour Guides, and Travel Agencies access enhanced Platform features through monthly subscription plans. Travelers may access premium discovery features through optional subscriptions. All current plan names, pricing, and features are detailed on the /pricing page and may be updated at any time with 30 days' notice. Introductory Beta pricing is valid through Q4 2026.
4.3 Listing Approval
All new Listings undergo a quality review by the Antologa team before becoming publicly visible. We reserve the right to decline, suspend, or remove any Listing that does not meet our quality standards or that violates these Terms, without liability.
4.4 AI-Assisted Features
Certain Platform features use AI models to provide personalized recommendations and conversational assistance. AI-generated content is provided for convenience only and does not constitute an endorsement, guarantee, or professional advice. You are responsible for independently verifying any AI-generated recommendations before relying on them.
5.1 Booking Process
When you submit a Booking through the Platform, you are making a binding offer to purchase the selected service. A Booking is confirmed only once you receive a written confirmation from Antologa. Availability and pricing are set by the relevant partner and may change without notice prior to confirmation.
5.2 Payment Processing
All payments are processed through PagueloFácil, our third-party payment gateway. By submitting a payment, you agree to PagueloFácil's terms of service. Antologa does not store your full payment card details. Payments are denominated in United States Dollars (USD).
5.3 Commission Structure
Antologa retains a 15% commission on the gross value of each Booking as remuneration for marketplace and processing services. Partners receive the remaining 85% less any applicable taxes or fees. Commission rates may be updated for new plans; existing subscriptions retain their current rate for the duration of their active subscription term.
5.4 Partner Payouts
Earnings are paid out to registered partner bank accounts on a scheduled basis (typically 3–5 business days after a completed Booking). Payouts are subject to a minimum threshold as defined in the partner dashboard. Antologa reserves the right to withhold payouts pending investigation of disputes, fraud, or policy violations.
5.5 Taxes
Partners are solely responsible for determining and remitting any applicable taxes (ITBMS, income tax, or other levies) on amounts received through the Platform. Antologa does not act as a tax agent and does not withhold taxes on behalf of partners unless required by law.
6.1 Partner Cancellation Policies
Each Listing specifies its own cancellation and refund policy, which is presented to you before you confirm a Booking. By completing a Booking, you agree to the applicable cancellation policy. Antologa does not override or guarantee partner-defined policies.
6.2 Antologa's Discretionary Refunds
In the event a partner cancels a confirmed Booking, or is unable to deliver the service as described, Antologa will facilitate a full refund of the amounts paid. Antologa may also issue refunds at its sole discretion in cases of documented fraud or platform errors.
6.3 Subscription Fees
Subscription fees are charged monthly in advance and are non-refundable except where required by applicable law. You may cancel your subscription at any time from your dashboard, and cancellation takes effect at the end of the current billing cycle. No prorated refunds are issued for mid-cycle cancellations.
6.4 Disputes
If you believe a charge is incorrect or a service was not delivered as described, contact us within 14 days of the Booking date at support@antologa.com. We will investigate and respond within 5 business days.
You agree not to:
- Violate any applicable law, regulation, or third-party rights.
- Provide false, misleading, or fraudulent information in your profile, Listings, or Bookings.
- Impersonate any person, entity, or authority.
- Post or distribute offensive, defamatory, discriminatory, or harmful Content.
- Engage in harassment, threats, hate speech, or abuse toward other users, partners, or Antologa staff.
- Attempt to circumvent Platform fees, commissions, or payment systems, including by soliciting off-platform transactions.
- Use automated tools (bots, scrapers, crawlers) without prior written authorization from Antologa.
- Attempt to reverse-engineer, decompile, or interfere with the Platform's security, infrastructure, or codebase.
- Post fake, incentivized, or manipulated reviews or ratings.
- Collect or harvest other users' personal data without consent.
- Use the Platform for any commercial purpose not expressly permitted by these Terms.
Violation of these obligations may result in immediate account suspension or termination, removal of Listings, withholding of payouts, and/or legal action.
8.1 Your Content
You retain ownership of any Content you submit to the Platform. By submitting Content, you grant Antologa a worldwide, royalty-free, non-exclusive license to use, display, reproduce, and distribute your Content in connection with operating and promoting the Platform. This license ends when you delete the Content or close your account, except for Content that has already been shared with or used by others.
8.2 Content Standards
All Content must be accurate, lawful, and respectful. You must own or have the right to use any images, text, or other material you submit. Content that infringes third-party intellectual property rights will be removed and may result in account termination.
8.3 Antologa IP
The Platform, including its design, technology, brand, trademarks, and all original Content produced by Antologa, is protected by intellectual property law. You may not use Antologa's name, logo, or branding without prior written permission.
Antologa processes personal data in accordance with Ley 81 de 2019 (Panama's data protection law) and other applicable privacy regulations. Our Privacy Policy describes in detail what data we collect, how we use it, your rights as a data subject, and how to contact our data controller.
By using the Platform, you consent to the collection and processing of your personal data as described in the Privacy Policy. You have the right to access, correct, delete, and port your personal data by contacting us at privacy@antologa.com.
We use industry-standard security measures to protect your data. However, no system is completely secure. We encourage you to use a strong, unique password and to enable two-factor authentication when available.
The Platform is provided on an "as is" and "as available" basis without warranties of any kind, express or implied. Antologa does not warrant that the Platform will be uninterrupted, error-free, or free from viruses.
Antologa acts solely as an intermediary marketplace and is not responsible for the quality, safety, legality, or availability of any Listing, nor for the conduct of any partner, guide, or traveler.
To the maximum extent permitted by Panamanian law, Antologa's aggregate liability arising from or related to your use of the Platform will not exceed the greater of: (a) the total fees paid by you to Antologa in the 12 months preceding the claim, or (b) USD $100.
We are not liable for any indirect, incidental, special, consequential, or punitive damages, including loss of revenue, data, or goodwill, arising from your use of or inability to use the Platform.
These Terms are governed by and construed in accordance with the laws of the Republic of Panama, without regard to its conflict-of-law provisions.
Any dispute arising from or relating to these Terms or your use of the Platform shall be subject to the exclusive jurisdiction of the courts of the Circuit of Panama. If you are a consumer, mandatory consumer protection rights under your local law may apply in addition to these Terms.
Before initiating formal legal proceedings, we encourage you to contact us at legal@antologa.com to seek an amicable resolution. We will endeavor to respond within 10 business days.
Either party may terminate the relationship governed by these Terms at any time. You may close your account from your dashboard settings at any time. Antologa may suspend or terminate your account immediately and without prior notice if:
- You breach any provision of these Terms.
- We are required to do so by law or court order.
- We determine that continued access poses a risk to users, partners, or the Platform.
Upon termination, your right to use the Platform ceases immediately. Sections of these Terms that by their nature should survive termination (including Sections 8, 9, 10, and 11) will remain in effect.
